Terms of engagement
These terms apply to estimate requests and commissioned work with Data Beaconpoint Co., Ltd.
Acceptance
By requesting an estimate, confirming a written proposal, or paying a deposit, you accept these terms. If you are accepting on behalf of a nonprofit or company, you confirm you have authority to bind that organisation.
Services
We provide custom impact reporting, donor communication materials, facilitated board sessions, and related chart suites as described in each written estimate. Deliverables, timelines, and fees are those stated in the estimate you accept.
Client materials
You warrant that spreadsheets, photographs, logos, and text you supply are accurate to the best of your knowledge and that you hold the rights or consents needed for us to use them in the agreed deliverables. You remain responsible for the factual accuracy of program outcomes.
Intellectual property
Upon full payment, you receive a licence to use the final deliverables for your nonprofit’s reporting, fundraising, and stewardship purposes. We retain ownership of underlying templates, chart frameworks, and working files unless a separate assignment is agreed in writing. Sample pages on this site remain our property.
Liability
Our total liability arising from a commission is limited to the fees paid for that commission. We are not liable for indirect or consequential losses, including fundraising shortfalls or grant decisions made by third parties. Nothing in these terms limits liability that cannot be limited under applicable law.
Governing law
These terms are governed by the laws of Thailand. Courts in Thailand have exclusive jurisdiction over disputes arising from these terms or our services, without prejudice to mandatory consumer protections where they apply.
